1. General provisions

1.1 Acceptance

By placing an order on fofly.com, the buyer declares having read these terms and conditions of sale and accepted them without reservation. Any order constitutes acceptance of the terms in force at the date of that order.

1.2 Purpose

These terms and conditions of sale define the rules applicable to any purchase made on fofly.com by a buyer acting as a consumer.

1.3 Scope

These provisions apply solely to the e-learning training sold through fofly.com.

1.4 Amendments

FOFLY SAS reserves the right to amend these terms and conditions at any time. The applicable terms are those in force at the date of the order. In the event of an amendment after the order has been placed, FOFLY SAS will inform the buyer in writing. The buyer has seven days to express disagreement. Without a response within that period, the new terms are deemed accepted.

2. Training offered

FOFLY SAS offers the following online training under the Fofly brand:

  • E-learning training — self-paced online programme available at any time, in multiple languages.

3. E-learning training

3.1 Registration and payment

The e-learning training is available online, self-paced, at any time. Payment is made in full online by credit card at the time of registration. Access to the training is granted immediately after payment confirmation, for a period of one month from the date of purchase.

Pricing:

  • 189 € for European customers.
  • 189 USD for customers outside Europe.

3.2 Cancellation and refund

The buyer benefits from a 14-day right of withdrawal from the date of purchase, provided the training has not been started.

By accessing the training content, the buyer expressly waives their right of withdrawal. Once the training has been started, no refund can be granted.

This waiver is explicitly collected at the time of purchase, before any access to the content.

4. Pricing

4.1 Sale price

The applicable price is the one in force at the time of the order, expressed in euros or US dollars inclusive of all taxes. In the case of a promotional rate, FOFLY SAS undertakes to apply that rate to all orders placed during the promotional period.

4.2 Price changes

FOFLY SAS reserves the right to modify its prices at any time. Any price increase after an order has been placed does not apply to that order. The price in force at the time of the order remains applicable.

5. Payment

5.1 Methods

Online payments are made by credit card via a secure system (SSL protocol).

5.2 Default of payment

In the event of non-payment, FOFLY SAS reserves the right to initiate the necessary steps to recover the amounts due, after a formal notice has gone unanswered for a period of 6 days.

6. Liability

FOFLY SAS is bound solely by an obligation of means in the context of online sales. Its liability cannot be engaged for any damage resulting from the use of the internet network: data loss, intrusion, virus, service interruption, or any other technical difficulty beyond its control.

7. Intellectual property

All content on fofly.com — texts, visuals, sounds, software — is the exclusive property of FOFLY SAS. Any reproduction, use, or redistribution, even partial, is prohibited without prior written consent from FOFLY SAS. The same condition applies to any hyperlink to the site.

8. Personal data

FOFLY SAS collects and processes the personal data of buyers for the purpose of managing orders and monitoring training progress. This processing is carried out in compliance with the General Data Protection Regulation (GDPR).

Buyers have the right to access, rectify, delete, and obtain portability of their data. These rights can be exercised by contacting FOFLY SAS at: contact@fofly.com.

9. Archiving

The computerised records of FOFLY SAS constitute proof of orders, payments, and transactions between the parties. Registration forms and invoices are archived on a reliable and durable medium.

10. Dispute resolution

These terms and conditions of sale are governed by French law. In the event of a dispute, an amicable resolution will be sought as a priority. Failing agreement, the French courts shall have sole jurisdiction.
